Your Right to Extend Your Stay
If you are currently in the U.S. on a visa, you may have the right to extend
your visa or change to another type of visa. You have every right to request an
extension if you want or need to stay in the U.S. past the expiration date of your
original visa. The key to obtaining a successful extension is to make
your request plenty of time
before your current visa expires. You can also request to change to a different
visa as long as you qualify for the new type of visa. Again, you need
to give yourself plenty of time for this process to be completed before
your current visa expires.
Your Right to an Adjustment of Status
Nonimmigrants who are married to a U.S. citizen or have U.S. citizen children may have
the right to remain in the U.S. and apply for a
green card. Category K visas are available to spouses and children who wish to join their
family in the U.S. as soon as possible. The spouse or child will enter the U.S.
as a nonimmigrant and be allowed to remain in the country until a visa
number becomes available for lawful permanent residency. If you are in
the country on a K visa and have complied with the terms of said visa,
you do not deserve to be removed.
Your Right to Remain in the Country
If your visa has expired or you entered the U.S. illegally, you may have
options to remain in the country. For example, immigrants who enter the
country to escape persecution can file a request for
asylum and withholding of removal, allowing them to remain in the country until
a nonimmigrant visa or green card becomes available. Also, if the Department
of Homeland Security or Immigration and Customs Enforcement places you in
immigration detention, you may have the right to go before an immigration judge and fight your
case to be released on bond.
